TVM Claim Settlements Reach $1.6 Billion for Endo International

Endo International Agrees to Settle 20,000 TVM Claims

Endo International and its subsidiary, American Medical Systems, faces significant TVM product liability litigation nationwide. The company recently agreed to settle 20,000 TVM claims, despite refusing to admit any liability. However, Endo International did increase its initial settlement offer from $1.2 billion to about $1.6 billion.

Prior to reaching this agreement, Endo settled another class action suit for $54.5 million in 2013. Then in April 2014, Endo agreed to settle an additional 21,700 TVM cases.

According to Reuters, Endo president and chief executive officer Rajiv De Silva said he was “pleased to resolve substantially all of the remaining U.S. vaginal mesh litigation claims facing our AMS business.”

The source noted that Endo was the first major defendant in transvaginal mesh cases to come to a resolution while other manufacturers like C.R. Bard and Johnson & Johnson’s Ethicon subsidiary are facing more than 10,000 lawsuits with trials scheduled for this fall.

In 2008, the U.S. Food and Drug Administration warned manufacturers about reports of possible complications with the devices. and in 2012 the organization ordered American Medical Systems and other manufacturers to conduct post-market safety studies to find out at what rate negative events were being reported. Most recently, the FDA announced this year that it was considering updating mesh to a high-risk device.
