The first postponement moved Jones v. CR Bard, originally slated for Dec. 3, 2013, to Jan. 10, 2014. U.S. District Court Judge Joseph R. Goodwin signed off on the postponement. However, the Southern District of West Virginia court didn’t give an official reason for that delay. Specialty finance company Case Funding notes that the postponement to Jan. 10 was the third time the case had been delayed.

Plaintiff’s Witness Causes Latest CR Bard Trial Delay

A judge postponed the case again because the plaintiff’s primary witness is unavailable, according to court documents. The plaintiff requested a continuance because expert witness Dr. Donald Ostergard needed to handle his wife’s “emergent medical needs.” As a result, this unexpected delay put the bellwether trial on hold indefinitely. The case is one of more than 6,200 involving CR Bard.
