Transvaginal & Pelvic Mesh

TVM Discovery Conferences Scheduled in West Virginia

Women across the U.S. continue to file transvaginal mesh lawsuits against the makers of these devices, which are used to treat pelvic organ prolapse and stress urinary incontinence. While these are common treatments, women may experience serious complications because of the mesh – including erosion, scarring, chronic pain and other issues that led to the need for the surgical removal of the device.

In a West Virginia federal multidistrict litigation, there are thousands of cases being filed against mesh manufacturer C.R. Bard. A recent order announced that the court has decided that bi-weekly discovery conferences via telephone will be beneficial to the overall proceeding. The conferences will begin on Sept. 26, 2014 at 3 p.m.

According to court records, there are currently more than 9,000 vaginal mesh lawsuits filed against C.R. Bard in the Southern District of West Virginia. The company is accused of creating faulty devices that lead to major complications as well as not providing sufficient warnings against the serious risks associated with using this device for treatment. Some of the cases against C.R. Bard have already concluded. In July 2012, a California superior court judge ordered the company to pay $3.6 million of a $5.5 million judgment. Additionally, the first bellwether trial against C.R. Bard concluded in August 2013 when another plaintiff was awarded $2 million.

This company is not the only manufacturer facing lawsuits, and court documents noted that there are more than 60,000 cases filed in the Southern District of West Virginia against American Medical Systems, Boston Scientific and Ethicon.

If you or someone you know needed surgery after suffering serious vaginal mesh complications and you wish to file a lawsuit, you might want to look into contacting an advocate or attorney who specializes in mass tort. He or she can provide you with sound advice and assistance as you move forward with your claim.
